Terms of Design
By contracting Glória H Design services and/or purchasing its products, you confirm that you agree to and understand the following Terms of Design, fully and without exceptions.
The designer reserves the right to refuse or cancel any project and/or order, with refunding when applicable.
Since all communication is confidential, none of it can be shared or forwarded to others without the designer's written consent.
Premade Designs, A La Carte items, and Add-ons will be paid in full, unless stated otherwise. For some Custom designs, there may be a Waiting List deposit. Said deposit will not be refunded, under any circumstances.
Custom Blog Designs will be paid in installments: the Waiting List deposit (non-refundable) plus as many installments as there are stantard revision rounds in the purchased package. Each installment will be paid within 48 hours, after each revision. Extra revisions will be paid beforehand.
If the client is satisfied with the Custom Blog Design before making use of every available revision rounds, the remaining balances will be paid in full, with a 5% discount for each untaken revision opportunity.
Any remaining unpaid balances will be paid within 48 hours of your final approval of the design. When applicable, the design will be installed and tested after the final payment only.
Waiting List deposits for custom services will not be refunded. If the client does not answer and send the Design Questionnaire within 1 month after receiving it, a new deposit will be required.
If the client needs to suspend the project, all the files will be saved for 1 yeard. Paid balances will be valid for the same period. That means the client can restart the project from the point where it had to be suspended.
If the client chooses to cancel a project, with proper notice to the designer, she/he will be given a design credit in %50 of the amount paid, valid for 6 months. If there is no communication from the client for longer than 1 month, the project will be considered cancelled without notice, which results in no design credits.
Once delivered, there are no free replacements of files. Our products are tested and revised beforehand. However, the client has 72 hours from delivery to report any bugs or corrupted files, if those errors are on the designer's fault.
At the time of installation, the blog/website must already have the main elements set up, such as widgets, page contents, and alike. It is the customer responsibility to backup all data and said elements prior to installation.
Installations usually takes a few hours to be completed.
Without Glória H Design's expressed permission, the designs cannot be used any other place/manner than where/how it was originally intended to. It is not allowed to upload the designs on multiple websites, unless clearly stated otherwise (e.g. products with multiple use license).
Our products are for personal use only, and cannot be used for commercial gain, unless stated otherwise (e.g. Custom Logo Designs).
Glória H Design reserves the right of displaying its works anywhere according to its convenience, even with commercial intents (e.g. Portfolio).
It is the client's resposibility to make sure to check the specificities of your chosen product, before purchasing.
Introduction
All the Terms of Design and prices are subject of modification and/or updates, without notice and are in effect upon posting.The designer reserves the right to refuse or cancel any project and/or order, with refunding when applicable.
Prices
All prices are subject to updates at any time, and will be in effect upon posting. If the price of a Custom Design is changed after paid the Waiting List deposit, the client will have 1 month to send the Design Questionnaire fully answered, without the new prices taking effect.Communication
The client and Glória H Design/the designer will communicate via e-mail, without exceptions.Since all communication is confidential, none of it can be shared or forwarded to others without the designer's written consent.
Timeline
The design process of Custom Designs can take anywhere between a few days and a few weeks to be completed. The client will be provided with estimated dates of start and end. Delays on payments, communication and revisions may affect the completition target date.Payment
Checkouts are done exclusively through Paypal, which is the most secure online payment service available on the web. There is no need to have a Paypal account to use it, though. Third-party graphic products
If the client wants to use a third-party graphic product (e.g. photo, clip-art, icon, font) that is not free for commercial use, she/he will need to purchase said product. It will then be sent to Glória H Design for the design project, and it will not be reused in future works for a different client.Graphics, photos, elements, texts and alike used in projects upon the client's request
The client will be held responsible for any graphics, photos, elements, texts and alike that are used in the design project upon her/his request. The client will also protect, hold harmless, and defend Glória H Design and/or the designer from any claim or lawsuit arising from unlawful use of any elements furnished by the client.Delivery and Installation
Any premade or custom product will only be delivered after cleared full payment. The same also applies for services, e.g., Installation of blog design. Design Updates
Glória H Design cannot guarantee the client that all the designs files will be storaged for updates. The client is encouraged to store a backup if willing to have that option in the future.Maintenance and Tech Support
Maintenance and Tech Support are not included in the final price, even though Glória H Design offers those services, too. The client can contact Glória H Design in order to hire the designer for that purporse.Risk and Responsibility
The entire risk as to the quality and performance of the project is with the client. We will not be held responsible for any changes to the original design, nor Blogger/Wordpress failure, such as delays or uncompatibilities. We will not be held responsible in any manner for any purchases, where damage, loss of data or problems occur. Backups are recommended before installing or making adjustments. Once the item has been delivered and/or used, we are not liable in any manner.Privacy and Authorizations
The client will authorize the designer to have access to any host/blog/website/etc when needed for the sole purpose of works related to the purchased design. The client's passwords and user infomation will not be shared by Glória H Design, and will be deleted as soon as the work is finished. The client is encouraged to change their passwords beforehand/afterwards, if willing.Act of God and Force Majeure
Glória H Design and/or the designer will not be held responsible for any inconvenience, delays or for projects that could not be completed due to Act of God or Force Majeure.Copyrights
All designs are copyrighted Glória H Design (Design/Shop), including any coding. Duplication, copying, altering, distributing, and/or reselling is forbiden. Glória H Design's copyright notices cannot be changed/removed from the products, nor made invisible/hard to see.Without Glória H Design's expressed permission, the designs cannot be used any other place/manner than where/how it was originally intended to. All Glória H Design products are compatible with the latest versions of most used browsers (Internet Explorer, Firefox, Chrome, Opera and Safari). The client must make sure to have programs always up-to-date.It is the client's resposibility to make sure to check the specificities of your chosen product, before purchasing.
